Welcome to Fit-Miss Activewear. The terms “we,” “us,” and “our” refer to Fit-Miss Activewear. Fit-Miss Activewear operates this store and website, including all related information, content, features, tools, products, and services, to provide customers with a curated online shopping experience (the “Services”). Our website is powered by Shopify, which enables us to provide the Services.

These Terms and Conditions, together with the policies referenced in them (the “Terms”), describe your rights and responsibilities when you use the Services. They apply to all website users, including browsers and customers.

Please read these Terms carefully. They include important legal information, including warranty disclaimers and limitations of liability.

By visiting, accessing, interacting with, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you must not access or use the Services.

Section 1 — Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your country, state, or province of residence and have the legal capacity to enter into a binding agreement. Where applicable, you confirm that you have consented to any minor dependents under your supervision using the Services on devices that you own or manage.

To browse the website, create an account, or purchase products, you may need to provide personal information, including your email address, billing details, payment information, and shipping address. You represent that all information you provide is accurate, current, and complete and that you are authorized to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity conducted through your account. Notify us immediately if you suspect unauthorized access. You may not transfer, sell, assign, license, or otherwise allow another person to use your account.

Section 2 — Our Products

Fit-Miss Activewear sells women's activewear, sportswear, clothing, and accessories.

We make every effort to ensure that product descriptions, measurements, images, colors, and other representations are accurate and current. However, colors and appearance may vary because of screen settings, lighting, device type, production batches, or other factors outside our control.

All product descriptions, specifications, prices, promotions, and availability may be changed without notice. We may modify, suspend, discontinue, or limit the quantity or availability of a product, including by person, geographic region, or jurisdiction.

Section 3 — Orders

Placing an order is an offer to purchase products from Fit-Miss Activewear. We may accept or decline an order at our discretion, including because of product availability, suspected fraud, pricing or inventory errors, payment authorization issues, or delivery restrictions. An order is accepted only after payment has been successfully processed and we have confirmed the order.

Please review all order information before submitting it. If you need to request a change or cancellation, contact us immediately. We process orders quickly and cannot guarantee that a request can be accommodated. An order cannot be cancelled after it has shipped.

All purchases are subject to our Refund, Cancellation & Exchange Policy.

Unless Fit-Miss Activewear expressly agrees otherwise in writing, products purchased through the Services are for personal use and not for resale or unauthorized commercial distribution.

Section 4 — Prices, Currency, and Billing

Prices, fees, discounts, and promotional offers may change without notice. The price charged will be the price shown when the order is submitted and confirmed. Unless expressly stated otherwise, applicable taxes, shipping fees, customs duties, import fees, and similar governmental charges are not included in the product price.

The storefront currently processes transactions in United States dollars (USD) unless a different currency is expressly displayed at checkout. Prices offered at physical locations, through distributors, or on third-party platforms may differ from website prices. Promotions may be subject to separate terms; if those terms conflict with these Terms, the promotion-specific terms apply to the promotion.

We accept Visa, Mastercard, and any other payment methods displayed at checkout. You agree to provide accurate, complete, and current billing and payment information and to promptly update information that changes.

You represent that you are authorized to use the selected payment method and agree to pay all amounts due, including product prices and any applicable taxes, shipping costs, or additional charges. Cardholders should retain copies of transaction records, invoices, and these Terms.

Section 5 — Shipping and Delivery

Our separate Shipping Policy explains our processing times, delivery methods, costs, tracking, and delivery restrictions and forms part of these Terms.

Fit-Miss Activewear currently delivers across Lebanon. Available delivery methods and charges are shown at checkout based on the delivery address. Processing and delivery times are estimates and are not guaranteed. We are not responsible for delays or interruptions caused by carriers, incorrect customer information, customs, severe weather, or circumstances outside our reasonable control.

Section 6 — Intellectual Property

All content made available through the Services—including trademarks, brand names, logos, text, graphics, images, videos, product descriptions, reviews, and the website's design and arrangement—is owned by Fit-Miss Activewear, its affiliates, licensors, or the applicable third party and is protected by intellectual property laws.

These Terms give you a limited, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial purposes. Unless expressly permitted by law or authorized by us in writing, you may not copy, reproduce, distribute, modify, publish, publicly display, download, store, resell, or otherwise exploit the Services or their content.

Section 7 — Optional and Third-Party Tools

The Services may provide access to tools, features, payment services, applications, or integrations operated by third parties. We do not own or control these third-party services and do not guarantee their availability, functionality, or performance.

Access to third-party tools is provided on an “as is” and “as available” basis, to the extent permitted by law. Your use of a third-party service may also be governed by that provider's terms and privacy policy. We may introduce new features, tools, or services, which will form part of the Services and remain subject to these Terms.

The Services may contain links to websites or services that Fit-Miss Activewear does not own or control. We do not guarantee or assume responsibility for their content, accuracy, availability, products, services, security, or privacy practices.

If you access or use a third-party website or service, you do so at your own risk and should review its terms and privacy policy. Questions or complaints about a third party's products or services should be directed to that third party.

Section 9 — Privacy

Personal information collected through the Services is handled according to our Privacy Policy. By using the Services, you acknowledge that you have read that policy.

Personal information may be processed by service providers, including Shopify, payment processors, delivery providers, analytics providers, and other technology partners, as needed to operate the Services. Information may be transferred to or processed in other countries subject to applicable law and appropriate safeguards.

Section 10 — Errors, Inaccuracies, and Omissions

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, transit times, or other information.

We may correct errors, update information, or cancel or modify an affected order at any time, including after an order has been submitted. If we cancel an order after payment, we will reverse or refund the applicable charge to the original payment method.

Section 11 — Prohibited Uses

You may use the Services only for lawful purposes. You must not use them to:

  • engage in unlawful, fraudulent, abusive, or malicious activity;

  • violate applicable laws, sanctions, trade restrictions, or the rights of another person;

  • infringe intellectual property or privacy rights;

  • provide false or misleading information;

  • transmit malware, viruses, or harmful code;

  • spam, phish, scrape, harvest data, or collect information without authorization;

  • interfere with, disrupt, bypass, or test the security or functionality of the Services without authorization; or

  • reproduce, resell, or exploit any part of the Services without written permission.

We may suspend or terminate access if we reasonably believe these Terms have been violated or if required by law.

Section 12 — Termination

We may suspend or terminate access to all or part of the Services, subject to applicable law, including for a breach of these Terms. You remain responsible for amounts due up to the termination date.

Provisions that are intended by their nature to survive termination will remain in effect, including provisions about intellectual property, limitation of liability, indemnification, governing law, and outstanding payment obligations.

Section 13 — Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services and products are provided on an “as is” and “as available” basis except for warranties expressly provided by Fit-Miss Activewear or required by law. We do not guarantee that the Services will be uninterrupted, timely, secure, error-free, or free of harmful components, or that every defect will be corrected.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent legally permitted and do not affect rights that cannot lawfully be waived.

Section 14 — Limitation of Liability

To the fullest extent permitted by law, Fit-Miss Activewear and its affiliates, directors, officers, employees, agents, contractors, service providers, licensors, and partners will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from or connected with the Services or products, including lost profits, revenue, savings, data, or business opportunities.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Where liability can be limited, Fit-Miss Activewear's aggregate liability relating to an order will not exceed the amount paid for the product giving rise to the claim.

Section 15 — Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Fit-Miss Activewear and its affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, losses, and reasonable legal expenses arising from your material breach of these Terms, violation of applicable law, violation of a third party's rights, or misuse of the Services.

We will provide reasonable notice of an indemnified claim. We may control its defence and settlement, and you agree to reasonably cooperate. This section does not apply where prohibited by consumer protection law.

Section 16 — Severability

If any provision is found unlawful, void, or unenforceable, it will be enforced to the maximum extent permitted by law and severed only to the extent necessary. The remaining provisions will continue in effect.

Section 17 — Waiver and Entire Agreement

Failure to enforce a right or provision is not a waiver. These Terms and the policies referenced in them form the entire agreement between you and Fit-Miss Activewear about your use of the Services, subject to any order-specific terms that we expressly accept.

Section 18 — Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms as part of a merger, acquisition, corporate reorganization, sale of assets, or otherwise as permitted by law.

Section 19 — Force Majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labour disputes, government action, power failures, internet or telecommunications outages, epidemics, pandemics, carrier interruptions, or similar events. Affected obligations will be suspended for the duration of the event and resumed as soon as reasonably practicable.

Section 20 — Governing Law

Lebanon is considered the country of domicile of Fit-Miss Activewear for these Terms. These Terms and any separate agreements under which we provide Services are governed by the laws of Lebanon, without limiting any mandatory consumer protection rights that apply based on a customer's location. Subject to those mandatory rights, the parties submit to the competent courts of Lebanon.

Section 21 — Changes to These Terms

The current version of these Terms is available on this page. We may update or replace part of these Terms by publishing a revised version. Where required by law, we will notify you of material changes. Continued use of the Services after an update takes effect constitutes acceptance of the revised Terms, except where additional consent is legally required.
